Brother died want to apply for his job on the compassionate ground

Hello sir, My elder brother died 2 months ago. He committed suicide. He was working as electrician at MSEB. My father was electrician. He had taken voluntary retirement due to some reason. After that my brother was appointed on compassionate ground. He had completed 5 years of service when he died and he had just got permanent and so nominee on his service book is still my father because he died before the original retirement date of my father i. e. date of retirement if he had continued his job. My brother was married. He has 5 yrs old daughter and his wife she is staying with her parents. Situation is such that my sister in law has claimed for the job and my father recommended my name and even submitted my application. Can I get appointed? And if my sister in law get appointed would my parents get 50 of salary and other benefits for their maintenance because they were totally dependent on my brother. I want justice for my parents they are helpless and now facing pressure.

This is my response to you:
1. Yes the parents can get 50% claim on maintenance;
2. They can claim Maintenance under Maintenance of Senior Citizens Act;
3. If there is dispute then approach the labour commissioner/labour court.

You can't claim that job. Only your sister in law entitled to get that job. If only your brother is permanent on post.
