Breach of contract and unfair termination by employer

24-Apr-2023 (In Labour & Service Law)

As per my employment contract, I was supposed to provide a 3 month notice to my employer whenever I wanted to resign. When I did that, my employer said he was terminating me basis my resignation mail and said he would not pay my dues for the 3 months. He had breached the contract and I would like to sew him for this. Wanted to check what are my chances and also what would be the cost for this entire proceedings.

Private employments depends on the private agreement signed between you can the company. We have to go through the termination clause to advise you on the legal remedies available to you. If it says that company can terminate an employee on any reasonable ground and he is not liable to pay due then there is nothing you can do. But if the termination clause says that dues shall be paid, if notice period is served then you are liable to get full and final settlement amount. If company denies the same you can send a legal notice asking for compensation plus the remaining amount.
