a teacher was working as blo but sdm saheb relaxed him on his family problems and appointed me as blo. he is my fellow teacher and don't have any family related problems, I do know it exactly, even I have more problems than him. I do have more work load in my school as I do teach two subjects and he teaches only one. a lot of none teaching staff is also available there. there is a lab assistant working in the school but the school has no laboratories, hence he is free. is it legally correct to appoint me to do the duty of blo

In the aforesaid matter Under Section 13B (2) of Representation of People Act, 1950, BLOs are appointed from amongst the officers of the Govt. /Semi Govt. /Local Bodies. Generally, one BLO is responsible for one part of the electoral roll.
That at the lowest level of the administrative machinery of electoral system are BLOs.The DEOs in consultation with the EROs of the Assembly Constituency (AC) appoint the BLOs. That BLOs would continue to discharge the responsibilities assigned to them by their parent offices and would remain generally under the control of their administrative department, but they would not be transferred without prior permission of the DEO.

This will be the responsibility of the BLO that he does not proceed on leave in any circumstance without making over his
election-related charge. That non-relieving for election duty is criminal misconduct.
Though certain observations have been made by the Hon'ble Apex Court and issued directives in the past asking for not assigning such responsibilities to teachers during their work hours.

That as per the query raised by you regarding legality to appoint you to the duty of BLO, yes, they can appoint you as a BLO.

That my view in the interest of justice it would be proper to file a representation to the concerned DEO describing your present situation and to relieve you from BLO duty. If he/they will not take any initiative, you may always approach the court.
