Availing of Pension benefits during criminal proceeding

Hi, As per govt rule, pension are as `property` asper article 300.my father ,govt employee,caught in prevention of corruption case in 2005 and got 2 year imprisonment from destruct court.later we appeal in haryana high court and its pending from last 12 year under proceeding. He has not got any pension and benefits till now. Please advise can he get the benefit now as the proceeding is going on in high court{but he found guilty by lower court}.
