Are hired bus driver also entitled to Employee Provident Fund schemes?

The School hires buses for picking up and dropping back students in the morning & afternoon- The EPF contends that the drivers of Buses should be enrolled as a member by the School. Where we are of the view the School has only hired the Buses for a specific time and as such awe are not covered by the provisions. We seek the view and position in this regard.

It would be better for you to file an RTI Application with the concerned labour department clarifying your position on the matter. Labour laws have now provided for provisions which do not allow certain benefits to be curtailed even though the labour is employed through a contracter.

The liability in the end will fall upon the school and it would therefore be better to get a formal clarification on the issue.
