Arbitrary administrative action without giving opportunity to be heard

28-Apr-2023 (In Labour & Service Law)
I am scale 4 officer in a PSU Insurance company. I was working as Senior Divisional Manager. A liability arose under a MACT claim due to the act of a vehicle dealer who did not deposit the premium against a particular cover note. The matter of non deposit of premium went unnoticed due to the negligence of my subordinate officers, and the matter of cover notes control was much below my job roles. The company transferred me 500 kms away from my place of posting and also recovered Rs. 5 lacs towards written down value of company owned car. I was never granted an opportunity to be heard before these administrative punitive actions. The CVO of the company ordered my transfer first and conducted the onsite investigation afterwards. I belong to a scheduled caste. Kindly advise me the remedies available to me for justice and action against the oficers for their criminal offence. Thanks.

The best recourse available to you is to file a civil writ petition before the concerned high court because it is one of the basic principles of natural justice that no one shall be condemned without being heard. Further, if you think that you have been targetted because of your caste you can also file a complaint under sc/st act against the culprits.
