Appointment on hold due to pending criminal case

12-Apr-2023 (In Labour & Service Law)
I had received offer letter from Konkan railway for joining, after clearing all the requirements. But due to a criminal case pending against me, my appointment was kept on hold. It's been 2 years now. After I filed an RTI, the railway is asking me to produce acquittal order for appointment. My case is MPID, 420, etc with 10 more accused and still charges aren't framed yet and it's been 6 years passed. So getting acquittal or discharge or quashing is not possible. Kindly suggest if I have any legal options left to get my appointment done? If yes, then what and how? Thank you.

sorry to know about your situation. Section 420 IPC is a compoundable offence and therefore if the complainant and you reach an agreement then the case can be withdrawn. Kindly share the details of your case and we can give exact opinion.

Yes, you have to file a Writ Petition in Court to expedite legal process to declare you either Guilty or Innocent by passing of a Judgement. Meanwhile, if the Lower Court is goint to take time with such legal process, High Court can order to appoint you in Konkan Railways until you won't get framed Guilty and Convicted.
