26 week Maternity Leave in Pregnancy on private sector is payable

HI, My wife is pregnant and working under a Private Company having employee strength more than 300. I want to know that 26 week Maternity Leave in Pregnancy on private sector is payable or not ? or if Employer is not agree with this so what to do in this case. how can we take a legal action for Employer.

First thing first, the law is applicable to everyone be it a private employer or a public undertaking. It doesn't change for anyone.
Secondly your wife's employer is bound to comply with the new laws of Maternity Benefit Act. If he refuses to do so then you can send them a legal notice for the same and can apprise this matter to the Labour department of the concern area. The authority will take care of it and your wife's employer may have to face penal provision for the same.
