2 months salary due but not received after resignation

28-Jan-2023 (In Labour & Service Law)
i was working with a limited company from past 2 years. In October 2019 i resigned the company due to late in salary from past 4 months. The amount was approximately Rs. 94000/- from which They reimbursed me Rs 50000/- & assure me for the rest to pay later. Now its been more than 3 months after resigning but i havent received my balance amount. i have called them & also sent them whatsapp msg for the same but theu only give me assurance to pay later. Please suggest me a way out. My salary was Rs 22500 pm

I have perused the contents of your query and would advise you to issue a legal notice seeking salary of 2 months failing which a Suit for recovery be filed against the directors of the concerned company.

In this matter firstly, you should have a legal notice issued against the defaulting company and ask for your outstanding salary, if still they don't pay, you may approach various judicial forums such as labour commissioner under labour laws, recovery suit under cpc, if criminal intent is there then you can file a cheating case as well.
