Last Updated: 01 Jan, 2025
By Advocate Chikirsha Mohanty

As per new Indian Criminal law, IPC Section 36 has been replaced with BNS Section 3 with effect from July 1, 2024.

Please refer to BNS 3 for updated procedures & punishments.

Wherever the causing of a certain effect, or an attempt to cause that effect, by an act or by an omission, is an offence, it is to be understood that the causing of that effect partly by an act and partly by an omission is the same offence.

Frequently Asked Questions

What is Section 34 of the IPC?

In section 34 of the IPC, it is stated that when multiple persons commit illegal acts to achieve a common goal, they are each held responsible for the crime just as if the act was committed by them alone. This provision that creates "joint responsibility" for an act is contrary to the basic principles of criminal law.
