OCI refusal because foreign spouse did compulsory military training

04-Mar-2023 (In Immigration Law)
I am an Indian national married to a German citizen, we live in Berlin with our two kids. In the past, Germany had compulsory military training hence my husband was conscripted for 9 months. All this was in his youth. We have been married for 10 years and I would like to move back to my country to be close to family hence I want an OCI card for my husband. The government directive says that anyone who has ever served under any capacity in foreign military or police service shall not be granted OCI. I would like to know if it is possible to challenge this in court on an individual basis or is it not possible?
