Legality of immigrant working in India

30-Dec-2023 (In Immigration Law)
My MIL has a manservant from Nepal working for her. He does not have a passport. But he has his name in Ration card, aadhaar card and SBI account in India and Nepal. He deposits his money earned in India in the account and is withdrawn by his family in Nepal. Is this legal?

You should get the Police Verification done of your Servant. Otherwise, if anything wrong happens tomorrow, if the Male-Servant either steals from your place where he is placed or if he gets indulged in committing any other crime somewhere or nearby, then Police will catch hold of you & ask you - Why you have not your Servant's Police Verification despite of regular promotion Police is doing these days. Not having a Nepali Passport is Ok but if he doesn't have other credentials satisfying as the valid proof that he belongs to Nepal or a Nepali Citizen, then you could land in trouble tomorrow for employing an Immigrant in India without getting his Police Verification done.
