My friend got married to her mother's first cousin's daughter. Is this marriage legal in India? They both are from North India and Brahmins. My friend's wife is technically her second cousin, but their parents are first cousins. My friend and his wife's grand parents were real brother and sister. They have same great grandparents.
As per Hindu Marriage Act, Sapinda relationships are prohibited. A Sapinda can be someone from either the paternal side or maternal side. Hence, one is not eligible under the Hindu Marriage Act to marry someone who is their Sapinda. For further information please feel free to get in touch.

I booked a unit through an real estate agency with Buy-back scheme in a project Gurugram in 2016 during pre-launch of the project but I did not receive any CPR/ Buy-back agreement after booking to sign. In 2019, I received SOA for my unit from builder CRM in which booking category was showing “C.P.R”. But at the time of possession SOA in demand was not showing booking Category. But at the time of possession, builder denied buy-back for my unit and said my unit is not under buy-back as I don’t have any executed CPR/buy-back agreement and advised me to retain the unit. I have email confirmation from real estate agency that my unit was booked under buy-back. I felt cheated on the name of buy-back. I am not sure what to do now, can someone please advise?

Hello, I am married and I built a three-story new home for my family to live on, on my own land 2 years ago and after 6 months of building the home, I let my mother and married brother (with family) live there without taking any rent in the ground floor. my brother took care of my mother because my mother didn't allow me to take care of her. my brother is occupying that home till now. He is neither paying rent nor vacating the house. I want to sell the house now but he is not vacating and blackmailing me with my mother's help to go to court by saying I betrayed my mother, forged document, and took the title of the land, which is a false allegation I paid the whole amount of the land and built the three-story with my own money and personal loan also. There is no rental agreement or anything of the sort. He has influenced my mother to frame me some kind of forged property occupier and my mother now blackmailing me to pay her some lacs of amount to get rid of them. I don't want my moth
In the light of the present facts and circumstances, it is important for you to obtain an injunction against your brother whereby he may be directed to vacate the property peacefully and not disrupt the process of sale of the property. We have brought a land 30 years ago. The property was named with my mother and one of my uncle. We have paid him his share already 30 years ago but he said that he will transfer the ownership later. So we have built a house on the whole land. He has never lived here or even visited here. Now after the 30 years when we asked him to transfer the ownership he is asking for huge amount of money and saying to file a case. We have been living here in 30 years all the house tax, electricity bill we have been paying. What are my options here.
In the present circumstances, it is advisable to procure any document that you may have signed confirming the payment of the share of your uncle 30 years ago and subsequently shooting a strongly worded Legal Notice to your uncle informing him of the said document confirming settlement 30 years ago and thereby asking him to stop making such claims which already stand settled. Further and better particulars are needed for an effective opinion.

I have taken a home loan for under construction property from ICICI bank under subvention scheme, where builder had to pay the interest. Now, the project is stalled and project company is in NCLT. I filed a case in RERA and a verdict has been issued by RERA to builder to refund my money - first to bank and then balance to me. Currently, I am paying the pre-EMI. My queries are: - If I stop paying pre-EMI, I understand bank will deposit my blank security cheques given by me at the time of loan sanction and initiate Sec 138 against me. Will this case of Sec. 138 hold against me, in light of RERA order? - Is there any other legal precedent, where court has given relief to home buyers in similar case with respect to bank EMIs? If there is someone who has expertise in this with relevant case-laws, I would like to engage him professionally. Loan amount is Rs. 1.7 cr.
A careful perusal of all the necessary and relevant case related documents including pleadings, judgment/orders is vital to arrive at an opinion. Also it is important to provide a brief narration of the facts of the matter. Further and better particulars are needed for an effective opinion.
