I paid booking amount of around 5 lacs for an under construction flat in Gurgaon. Total price of flat is around 4 crores. Only allotment letter given by builder. BBA not signed yet. I want to cancel the booking. Will I easily get the booking amount I paid? What does RERA say about this.?
Booking amount can be forfeited if the same is mentioned in the agreement signed between you and the builder. RERA cannot override the effect of your liabilities mentioned as per law in the agreement which is enforceable in law. However agreement needs to be perused for any better advice. Dear sir , after 1 year of company dissolve from NCLT Order i received a complaint from customer complaint from MCA mail , what can i do right now? MCA said in mail - if within 15 days reply failing which necessary action under 206 of the Companies Act, 2013 Kindly suggest me reply or what i do for needful action.

Hi Wife filed 498a in AP state, immediate filed DVC(against my entire family) in TS state, in DVC Interim Maintenance is allowed, then after 2 or 3 months later she filed 125 MC in AP state where she filed 498. means in AP 2 cases(498, 125), TS state 1 case. her intention is harass me and get Maintenance. What merits required to SC transfer/club at all one Court.? wife harass filling case across states for Money and make me/entire family members feel inconvenience?
If the wife has filed the cases only to harass and within multiple jurisdictions, you can file a transfer petition in Court to transfer all the matter to the correct jurisdiction or if filed in one jurisdiction court then all the matters can be clubbed to be heard together. The owner of my Ancestral property is my father and his elder brother. Elder brother died. His family stays out of station. My father paid money to them on behalf of the property without any document but now they refuse to transfer the property. How to transfer the property in my father's name. We have the death certificate of the deceased.
If the property is ancestral then you would require to seek partition from the other parties who claims to have share in the same. Our case ( complainants) has settled in Mediation of one of the district courts however the respondents were supposed to complete first motion (first payment) in the first week of April 2024. Our lawyer says their advocate is delaying the matter and not signing on the affidavit. We have still not withdrawn any case but little doubtful that our lawyer has started advising them to get rid of the settlement and assisting them to come out of it or may be giving other alternatives to them. If the other side is not abiding the terms of settlement you may initiate legal proceedings against them. Mutual divorce is filed on the amicable decision of both the parties and if once has mischievously used the settlement to avoided serious proceedings then the same needs to be addressed to the court immediately.
