After that I make no of calls to her and her mom and to their relatives no body is responding properly after 2 days I got a call from police station, sub inspector said that ur wife complaining against you, you will come to the station immediately for enquiry at that I tried to explain the actual situation he didn't listen my words and said that you come and explain here...i said. OK sir.(The case registered under 498a with other cases and sections) After I reaching police station they asked me no of irrelevant questions like do you forcibly acquire land property from your aunt by black mailing?? I said to the Inspector no sir its actually purchased by me and properly registered. My is not interested to come back and demanding for lakhs of rupees and the land what I have purchased.
what about said land saledeed you did not mentioned. however the burden of proof lies up on you to prove what happend. here in this case what about u r aunt financial capacity to give all..... and the case was sufficient to you to file hmop or fcop ...
Hi
Since 498A is filed against you , you need to take precautions such as Anticipatory bail prior to police arresting you formally.
Also you should file a missing complaint(jewellery and cash) with the necessary police station and also file a restitution of conjugal rights petition just to protect yourself from unnecessary harassment by your wife and her relatives.
It also appears that your wife is making her moves under strong legal advise and we suggest you also take appropriate legal steps to protect yourself and your property from undue harassment.
Hope this information is useful.

If your wife has stolen jewelry or money from you and has also filed a false Section 498A case against you, it's essential to take appropriate legal steps to protect your rights and seek justice. Here's what you can do:
- Gather Evidence: Collect all available evidence related to the theft of jewelry and money, such as receipts, photographs, bank statements, or any communication that can support your claim.
- File a Police Complaint: Report the theft to your local police station by filing a First Information Report (FIR). Provide all the evidence and details of the theft to the police. Ensure that you maintain a copy of the FIR for your records.
- Consult a Lawyer: It's crucial to consult with an experienced lawyer who specializes in family and criminal law. They can guide you through the legal process, help you with your defense against the false Section 498A case, and advise you on the steps to take for recovering the stolen property.
- Legal Action: Your lawyer will assist you in filing a criminal case against your wife for theft. This will be a separate case from the Section 498A case. Ensure that you have all the necessary evidence to prove the theft in court.
- Section 498A Defense: If your wife has filed a false Section 498A case against you, your lawyer will help you build a strong defense. It's important to provide any evidence that can show the allegations are false. The court will consider both sides of the case.
- Mediation: In some cases, mediation or negotiation with the help of a lawyer can lead to a resolution without going through a lengthy court battle. Discuss this option with your lawyer.
- Protect Your Rights: During the legal proceedings, it's essential to protect your rights and interests. Follow your lawyer's advice and attend court hearings as required.
- Property Recovery: If the stolen property has not been recovered, your lawyer can help you take legal action to recover it. This may involve civil proceedings or filing a case for the return of the stolen items.
