1. i am nagaraj rao chartered accountant , mysore. hindu 2. query :whether the below-discussed property is absolute property of my mother or family property ? details :my father Sri c h 1934 born: died in 2015.: Govt servant, He . married my mother Vani bai in 1962. 3. 2 sons and 2 daughters were born. my biological younger brother has been given off in adoption in 1983. deed registered in Subregistrar office. 2 sisters are married. 4. in 1972 Ch rao bought a property : he took a loan of 25k, the property sale consideration . it was registered in my mothers name; 5. my mother was a house wife. she did not have any source of income . 6. my father died intestate: he died in that house 7. it was used for residence of the full family. mother did not derive any rent/ any other benefit therefrom 8.my biological brother, is trying to get a settlement deed in his favor by my mother, that it is her abs. property 9. whether it is benami_ thus family property or my mother's absoute ?

Dear Sir,
It is not a benami transaction but purchased by the husband in the name of wife out of love affection. Secondly after the death of father all the legal heirs including wife entitled for equal share ( except the son of the deceased who was given in adoption). It is not her absolute property.
