Son has abandoned senior parents
09-Sep-2023 (In Family Law)
Hi. I am younger son and my father is retired defence personal now a senior citizen. My brother and his wife are emotionally torturing them. Brother does not speaks to my mother he is in different state than my parents. He never talks never cares about them parents are so disturbed by this. He has also planned to settle along with his wife near her hometown which has terrified parents. What can my parents do now they only seek love and presence of brother
Legally there is no provision which can compel your brother to stay with your parents. However, he is under obligation to maintain his old aged parents and your parents can seek maintenance from him under section 125 CR.P.C if he not maintaing them. Along with this, they can send him a legal notice that if he doesn't stay with them and leaves them and the property they will disown him from the properties etc. These steps may compel him to stay with your parents.
