Right of wife in husband's property

My father is a drunkard, he beats and abuse my mother. Till now she tolerated all this with the thought that at least she had home and daily bread because of my father. But now my father had started to threaten us ( me and my mother, I and my small brother are still unmarried. Brother is employed but I am not) that he will bring us on road and will sell or donate our home and we will be thrown out. We have no access to bank accounts or Father's pension as everything is in his name. There is no need for him to sell home as he has retired from government job three months back and he already has a lot of cash with him and a good monthly pension also. Do we have to leave our home? Can he actually bring us on road?

Hi, this is a common Indian problem. there are some of options available just like your mother can suit a case for living and food. If you are minor then you can also able to get such compensation from father but adult not. You and your brother can only sue for the parental property of your father not on such property which is earn by your father own. Yes if those property or house which is owned by your father then there is only permission for him to stay with him or not, but in your mother's case it is his responsibility to take care of her and give her place to live even other necessities will must to full fill by your father. You both brothers are adult so this is also your legal responsibility to take care of your mother. your mother can also suit a case against both of you same like your father. Even father can also suit a case against both of you for take care of him.
