Query about brother whose behavior is causing trouble to old parents
12-Nov-2023 (In Family Law)
I am currently out of India with my husband. My elder sister, like me, is also located abroad for work.My brother lives with my parents at our home in Kolkata. My brother has a history of thefts, joblessness, drunken behavior & is a proven defaulter in financial matters. My sister & I support our family financially. My brother has no contribution in the well-being of my parents nor our home. My brother (27 years old) is hell-bent on marrying his girlfriend (25 years old, residence at Siliguri). We have no objection to his choice or the marriage. We simply request him is to bring himself to a financial position to be able to sustain his wife & thereby his future family. His habitual lies & reckless, irresponsible misdeeds are depleting the resources of our home in ways I cannot define. Both my parents are aged & retired. My mother is also a patient of dementia. In the current scenario, my father is becoming helpless day by day.Pl. advise.
If a child in parents old age cannot support the family and look after aged ailing parents, court has strictly stated that such children should be disowned by the parent from their life and be removed from share of the property. Only by consent of parent, their children can stay in their home or else not. This should be informed to your brother with strictness
