Procedure in case elder brother is not dividing property equally

Hi My father has 2 elder brothers and 1 younger brother.In year 1991 1st elder brother divided and left home.Later on 2nd elder brother, younger brother and my after started business and the name of business was in my father's name including bank account ( Current Account 3members.He was basically in mining work during his day he would travel to work for long duration and he would once for all get lakhs and hand it over to his 2nd elder brother or deposit it to bank. Proble is with 2elder brother, he would withdraw money some time in his name or by self check and invest it in his factory.During this time he alsopurchasedfewproperties and my dad thought he is purchasing all in my grand parents name as they were with us. During purchase of one property he sold his one plot and sold my days plot and purchased a huge plot and told it will be registered in grandparents name.
