Pension for second wife in military if divorce not given to first wife
18-Aug-2023 (In Family Law)
My uncle who was into military services was married with his first wife in a christian marriage and had 3 daughters. After 3-4 years, due to infedility of the 1st wife they both were invlolved in a court case to file divorce. First wife claimed for alimony, whis is rejected by court and was declared to give financial help only for his first wife childern. Later this case is not finalized or given divorce. Later he married his second wife in a christian marriage who bore 3 children again. Both wives never had any issues with each other legaly till the date. My Uncle used to get military pension. Recently my uncle passed away. Unfortunately his second wife name is not included in military documents. When checked with military authorities they are requesting for a divorce certificate of 1st wife. First wife is still alive. How do we get the divorce certificate of the first marriage if the husband is no more? How do the second wife who have spent all the life with him get the pension.
whether first wife received permanent alimony or not, if she got permanent alimony without divorce she has right to claim pension and other benefits at the same time second wife and her children not denied the rights cont.advocate further details
