parents aren't divorced but my father changed the locks of our house

24-Aug-2023 (In Family Law)
Due to some issues, me, my mom and my younger sister had to leave our house 8 months ago. My parents aren't divorced but my father changed the locks of our house and put it on rent, after we left. All our belongings are still in the house along with all my important documents. I came to bombay 2 months ago, this year and wanted to break through the house but I didn't. The rental lady, she is not even a rental for real, she is a family member itself, she put a complaint against me saying 'she broke the locks.' I am a 16 year old and my father has got two false complaints filed against me already. The society committee members have banned me from entering the society. Also, warned all my friend's parents to stop talking to me as the committee members say, my father has given them a letter saying 'none of my family members should be seen in the building' but nobody shows me the letter. I need a lawyer for suggestions. Please help me.

It seems that the house you are talking of is the matrimonial house of your mother. In this case you must get your mother to file a domestic violence petition in Court so that her rights of accommodation are secured along with her children's. If the tenant you are talking off does not have a proper leave and license agreement in place it will not be difficult for you to gain access to the house. Did your mother ever file a police complaint against your father? Being an heir to your father's property the society cannot take such stern action against you just on the basis of a letter given by your father. You need to move Court immediately.
