My first wife had a external affair and has remarried what can be done

I have a issue is that i had been married to Christian girl but do not have any evidence she had an external affair and got married and has a girl baby from her second husband.i also got married have photo and proof of second marriage.ow first wife has filled a maintenance case will it pass
Hi, as per your query it is understood that both you and your first wife have entered into second marriage without nullifying the first marriage through a Divorce Decree. Any such further Remarriage without divorce renders the second marriage as bigamous which is an offence and punishable under section 494 of IPC. On the basis of all the material facts and evidence that you have in hand, the case has to be dealt in the court of law to convince the Hon'ble Judge that the maintenance should be quashed on the grounds of extra marital affair and remarriage without divorce.
