more than 8 motnhs not getting mutual divorce

in my 5 n half yrs marriage i have 1 child of 2 yrs my wife was haveing afair from 4 n half yr i caught her she ram away from my house and threathened me to will put me in jail in domestic voilence n dowry ,from 1 month half she was saying me she will do mutual divorce n dont want any money only my child , so i said okey , but whenever i am asking abt mutual divorce she is saying tommorow i will visit laywer, i said i will prepare the petition u just come to court ,she is not accepting that , i m total confuse wht she want, as we r seprated from 8 n half months can i file contested divorce , some where i read i should wait for 1 yr is it true ? please advice me correct update 2018 october law information regarding contested divorce
