Misuse of Sec 498a by sister in law
06-Dec-2023 (In Family Law)
My brother got married to a girl ( lawyer by profession) from Gwalior in Jan 2017 and they were staying with my parents in my hometown Jaipur. She started creating issues inthe family soon after marriage. When things were not working fine even after all discussions with the girl and her parents. My brother and she got separated from my parents and the girl took all her wedding gifts ( streedhan) we have a 500₹ stamp paper mentioning that she received all her streedhan. Even when they got separated from parents she will keep fighting with my brother. When my brother decided to get separated from her and my parents called her parents, the girl and her parents came to my dad house and started beating my family. My nani was present that time and was also beaten by her. FIR was lodged by my cousin. Later on that girl filed a FIR against my parents, brother, me and my sister under sec 498a. Me and my sister are married stay in another city and hardly met her once or twice after marriage.
If the case has been registered and the Police has filed the challan in the Court, then you all will have to defend the case.
You can also try filing a petition before High Court under section 482 CrPC for quashing, as you and your sister live in another city, but no one can guarantee it's results. You can try, but be ready to defend the case.
