Husband and wife lived in mumbai which is in the name of Husband's Father with two children both girl one aged 22 and 2nd 14.. Husband passed away without making will .. Husband's Father is threatening Wife and their children to vacate the house .. Is the Wife and her children entitle to stay there as per law.. please help what is the law ..and the Law falls under which act..
Dear Queriest, as per your query your husband has passed away without making any WILL of his property. Therefore even if he has not made any will you and your kid can claim for the same by filing Succession Application before the Honorable court for your share which has right to be given to you and your kids as a part of legal heir class I.
