Hi What is the status of 2nd marriage(court marriage with muslim ) when one of the spouses is already married as per hindu rituals. What can the 2nd wife do to secure the child with her when husband demands to take away the child
If the husband has two marriages the mother of child can file for custody of child in jurisdiction court. The court will take into consideration the benefit of the child and it's welfare.
Usually second marriage is not recognised if the person marrying is Hindu and has not converted to Islam. And he can be prosecuted for bigamy.
