Daughter's right to share in HUF property

18-Jul-2023 (In Family Law)
I was borne in a Punjabi family. Hindu is my religion. I am the only daughter of my parents and now married for 15 years. My father owns a joint property in noida where he lives with his other 2 brothers who are also the partners of the same property. Now in order to safeguard my interest in the same he wants to sell this property off. His younger brother is ready but the elder one is reluctant to sell it. I am the only daughter and wants to know the best way out. All of these brothers have a their independent floors in the house but it can't be registered separately as of now for the purpose of selling . The brothers also don't have enough money to give the share to my father in terms of money. How can this be sold if only 2of them are ready?

If he wants to sell his share in the joint property, he needn't take the consent of the other two brothers. He may sell is undivided his share in the joint property to any third party/outsider without taking any kind of NOC or permission from the other 2 brothers. Upon such sale, the new buyer will step into the shoes of your father and may ask the other 2 brothers for the partition of the property by metes and bounds.
