I got married 3.5 years ago.My husband is having an extra marital affair. That women and my husband have a child out of our marriage of 3.5 years. That women was married to someone else at the time of conceiving and later revealed that it is my husband child. Now that women is blackmailing that it my husband doesnt talk to her or have a relation with her as extra marital then she wil commit suicide. What are the legal implications on my husband if she dies by suicide? What are the rights of her child in my husband and husband's father property?P.S. She is still married to someone and has put his name in child school. We are Hindu.

Query perused. I would advise you as under : that in case the women with whom your husband has an affair commits suicide and gives a dying declaration that your husband would be booked for abetment to suicide under section 306 and can be punished for a term upto 10 years. So far as Hindu Succession Act is concerned it does not differentiate between a biological child or an illegitimate child. For further consultancy and legal services you may contact us.
