Can I claim my mother Settlement Money, without her signature

Mr. who works in railways, married to  and having daughter . Due to death of , his wife  got her husband job in Railways on Compassionate grounds. After few years  was married to  (works in Railways). Before was married to , he was married to  and she died of her ill health leaving  with two sons. At present both  and works in Railways taking care their children and they themselves did not have children after marriage. In Jan2017, was completely paralyzed and will become medically unfit by Oct2017. As the final settlement procedure is going to start in Oct2017,  started claiming to take the entire settlement money and will not give a penny to (Married). As  desired to give the settlement money to her daughter before she became paralyzed, but her present health condition is not favoring her. In this situation, does  eligible to claim her mother’s settlement without her mother’s signature?
