Can a father who abandoned his child, claim allowance at after 60 yrs

My father abandoned me when I was a child (6.5 years) and my brother (3 years). My mother divorced him after few years (fasakh). We have not heard from him in past 28 years (I am 34 now). He haven't sent a letter or inquired anything regarding our bring up. Now, on a fine day, he sends a legal notice as per "Maintenance and Welfare of Parents and Senior Citizens Act" claiming monthly allowance! He was waiting to reach 60 years! I need to counter this and also file a counter case to withdraw his parental rights on me. My mother is married to another person and they both brought us up together.
The Maintenance and Welfare of Parents and Senior Citizens Act defines the word parent, and no such distinction is made between abandoned parents and other parents. But you can couter the case stating all these facts. Since the act came into existence only on 2007, such a distinctions were not made by court of law by their verdicts. Here you can file counter stating all these facts and you can prove his malafide intentions in filing such cases.
