Can a case be filed against the guardian if not fulfilled his duty

Im elder sister to my brother.. I wanted to file a case against him for my financial problems.. my father and mother has passed away and I'm single parent for my major daughter.. Now I wanna file case against them for my rights.. My brother was a guardian for my daughter till minor.. but he never did any thing as guardian.. So can I file a case against him.. will I able to win the case
