02-Jun-2023 (In Family Law)
My father has done 2 marriage from 1st he have 3 sons and 1 daughter and from 2nd he have 1 son and i am from his 2nd wife n i have proofs like marraige certificate and some pics of marriage n my mother n father had passed away so i m fighting for my share but they r refusing for it what r d docs which can proof my relation n how much acceptable is Dna test in court and should i go through it or not means can it go against me like my father is no more so will my dna match to my step brothers dna. N they r saying that father name is same but the persons r diff. So how can i proof it?
The court can compel anyone to undergo a DNA test unlike lie detector test or narco analysis test as the same would not be in contradiction with right against self incrimination. However, you must be sure that the test would prove you right, otherwise, this would be a serious allegation and the court would take that seriously. Also the other party may file a defamation suit against you.
