Ask for Maintenance and share in property from inlaws after death of

Hi, my husband had been expire and his parents get death claims and all his property by cheating and transfer each and everything to their daughter intentionally. I ask for mentainance to them and file case in court. Now they are showing as they are also dependent on their daughter. And gave all 3 flats and my husband insurance and fd after withdrawing by fraud and transfer to their daughter. I also have one daughter who is minor and they did keep me and my daughter in their home and claimed on my husband property. I want to know in such situation I ask for maintenance and property claim for me and daughter from my husband parents and sister. I have proof all their frauds and can prove easily in court. Will court And law consider and justice to return my husband property and share which was fraudlly taken by his sister. My husband was only one son and had one sister. Please suggest me should I fight for my rights and what's are in my favour?

In this regard, I advice you that you first file for cancellation of all those documents in which such properties have been transferred thereby alleging that the fraud has been played upon you to usurp the property and thereafter you being the legal heir of your husband can get those properties of your husband in your name via Indian succession act. Therefore, firstly you need to get those forged documents cancelled and then seeking declaration of those properties in your name. After the death of your husband, you become the legal heir in whose favour the property has to devolve and there is no right if anyone if the same has not been named to anyone in will by him. You need to understand there are two ways of inheritance ie intestate and testamententary. You have good case and don’t spend much time as you will lose if you don’t raise your voice by filling some Otho good in court. For further clarification, please contact.
