Hi law expert's, I would like to know, if wife is earning 3 to 4 times more than husband is she entitled to get interim maintenance in her favour? The fact of the case is, wife is earning 3 lakhs per month(private sector)where husband earns 60000(govt servant)rs per month,and wife has filled for interim application seeking 1) 25k for monthly flat rent .2)1crore rupees for interim compensation. Please throw light on this matter.thanks in advance.
you see if you go through section 24 of Hindu marriage act, both have right to claim maintenance, as you are earning 4 times less, it is you who has to file application for maintenance as now days maintenance means you should be able to maintain in the same standard of living as she is enjoying, further as per the supreme court guidelines but have to file their affidavit of assets and liabilities and court will consider it ,taking into consideration other facts and circumstances, so i advice you to file maintenance case, instead of her asking, her application will be rejected in most probablity.
