To change your name on both a sale deed and Aadhaar card, here?s a clear step-by-step process:

Step 1: Change Your Name Legally

  1. Affidavit: Prepare an affidavit for name change on a ?10 or ?20 stamp paper, stating your old and new names, reason for the change, and personal details.

  2. Newspaper Publication: Publish a notice in two newspapers (one local, one national) announcing your name change.

  3. Gazette Notification: Submit a request to the official government press to publish your name change in the Gazette of India (especially if required for legal documents like sale deeds).

Step 2: Update Aadhaar Card

  1. Visit the UIDAI portal or an Aadhaar Seva Kendra.

  2. Submit:

    • Name change affidavit or Gazette notification

    • Identity proof with your new name (e.g., PAN, passport)

  3. Fill the update form and pay the nominal fee.

  4. You?ll receive an updated Aadhaar card with the new name.

Step 3: Update Name on Sale Deed

  • You cannot alter a registered sale deed directly.

  • You need to execute a rectification deed (also called a correction deed):

    1. Draft the rectification deed with the help of a lawyer.

    2. Get it signed by both buyer and seller.

    3. Register it at the same sub-registrar office where the original sale deed was registered.

    4. Submit supporting documents (updated Aadhaar, Gazette, etc.)

You will need to rectify the sale deed to show your name in conformity with the aadhar. You must bring your and you previous transaction records to show how your name appeared therein. Whether in conformity with the Aadhar ?

If you have a name difference between your Aadhar card and a land document, such as a sale deed, it's essential to address this issue to avoid legal complications. Here are steps to consider:
  1. Verify the Discrepancy: Carefully review both your Aadhar card and the sale deed to identify the exact differences in your name. Ensure it's not a typographical error.
  2. Aadhar Card Update: If the discrepancy is on your Aadhar card, you should initiate the process to correct the name on your Aadhar card. Visit the nearest Aadhar enrollment center or do it online through the official UIDAI website.
  3. Legal Assistance: If the name difference is on the sale deed, consult a property lawyer. They can advise you on the legal steps needed to rectify the issue.
  4. Affidavit: In some cases, you may need to execute an affidavit stating that both names refer to the same person. This affidavit can be prepared with the help of your lawyer.
  5. Gazette Notification: Depending on the seriousness of the issue, you may need to publish a gazette notification about the name change, which will serve as legal evidence.
  6. Documentation: Ensure that all legal documents, including the sale deed, reflect the corrected name consistently.
  7. Property Records: Update property records with the corrected name to avoid future disputes.
  8. Notarization: Any changes made to legal documents should be notarized for validity.
