05-Aug-2023 (In Divorce Law)

My wife knew before the marriage that I currently do not work and pursuing my studies and income from my freelancing is pretty low however my family has a stable income. Yet she agreed to get married. Now after 4 months of marriage she left my home after a small fight in may and now not returning wven after all the requests and now staying with her parents. She is pregnant. She wants me to seperate from my parents. In there 4 months we had regular quarrels over small issues like finances and family, i did shout on her couple of times & she did the same. Now she is comply denying to return, she des not talk about divorce or anything. Its just she wants to torture me and its really affecting my work and studies both. She is not understanding how badly its going to effect our future. Looking for immediate suggestions

After the solemnization of the marriage if either of the spouses without reasonable excuse withdraws himself or herself from the society of the other then aggrieved party has a legal right to file a petition in the matrimonial court for restitution of conjugal rights. The court after hearing the petition of the aggrieved spouse, on being satisfied that there is no legal ground why the application shall be refused and on being satisfied of the truth of the statements made in the petition may pass a decree of restitution of conjugal rights.

You can seek a divorce from your spouse if they have abandoned you. This order, despite its name, does not terminate your marriage. You may be entitled to certain divorce benefits, including alimony and child custody.
