Wife filed false dowry case will it come in background verification

11-May-2023 (In Divorce Law)
Hi Sir, I am a hindu male. I have received a job offer from a very good MNC. My wife is going to file a false dowry 498A and DV case. I was called by Mediation Center for counseling. When I applied for job I mentioned "NO" for two questions"Have you ever convicted of a criminal offense" and has anyone ever filed/loged an FIR against you" I mentioned "NO" because there was no FIR at the time of filling application. I will be joining the company next week, and I am expecting an FIR against me. Will company expel me from employment because I mentioned "NO". The company will do background check and find out FIR which would be filed before one of week of joining date. Will they consider it fraud for providing misinformation in application? I was going through Mediation counseling while applying job, but that is not a legal FIR so I mentioned NO. Does 498A provide ground to a private company to terminal the job. Please help. Thanks

  • Regarding Your Job Application ‘NO’ Answers:
You honestly answered “No” because at the time of application, no FIR was filed. Mediation counseling is not an FIR, so your answer wasn’t a lie—it was true as per facts then. So, technically, you didn’t provide misinformation.

  • Background Checks & FIRs After Joining:
If the FIR is filed after you joined, it may not impact your hiring initially. But companies often have clauses about “material change” in your status. They may review if any criminal case arises during your employment.

  • Can 498A Lead to Termination?
498A is a criminal allegation, and many companies may wait for a formal charge sheet or conviction before taking action. Mere FIR or complaint doesn’t usually lead to immediate termination, especially if you maintain your innocence and the matter is under trial.

  • Your Best Move:

    • Keep the company updated if asked. Transparency is better than being caught off-guard later.

    • Get a good lawyer ASAP to handle the 498A and DV case so you can respond quickly if an FIR comes.

    • Mediation records show you’re trying to resolve issues, which is a positive.

  • Legal Protection:
Remember, filing a false 498A is punishable. If your wife files false complaints, your lawyer can move for quashing the FIR or anticipatory bail.

This depends upon the company to react over the issue, but in my opinion each and every company have there own policy for there employee's conduct. If the company takes it as the misconduct, as your behavior is not good against the women then you will be in trouble. In my advice go and file Petition for Quashing of FIR. Thank you

Helo, after Persuing your query that there is no such kind of act has been done by you that company will expel you. It’s a matrimonial case and family disputes ,you are not a habitual criminal and not not convicted till now.
