First of all my wishes to you that you want to live with your wife. You approach an Advocate and give him details. You can file Restitution of Conjugal Rights in your jurisdictional Court and she has to appear for that case and you will have a chance of mediation. You can solve your problem. When a spouse leaves home and refuses to return, it can be a challenging and emotionally distressing situation. Here are some steps to consider in such a scenario:
  1. Communication: Initially, try to open a line of communication with your spouse. It's important to understand the reasons for their departure and if there are any underlying issues that can be resolved through dialogue.
  2. Legal Consultation: If your spouse's absence continues, consult with a family lawyer. They can provide guidance on legal options available to you, especially the option for filing for restitution of conjugal rights in the appropriate court.
  3. Filing for Divorce: If reconciliation is not possible, and you wish to end the marriage, you may file for divorce. In India, you can file for divorce on grounds such as cruelty, desertion, adultery, etc. Your lawyer will guide you through the divorce process.
  4. Maintenance and Support: If your spouse has left and is not providing for the household, you may seek legal remedies for maintenance and financial support, especially if you have children to care for.
  5. Legal Separation: In some cases, legal separation may be an option. This is a formal arrangement that allows you to live apart while addressing issues such as property, custody, and support without dissolving the marriage. It's a step toward divorce if reconciliation remains unlikely.
  6. Consultation with Local Authorities: If your spouse's absence is unexplained, you may consider seeking assistance from local authorities, such as the police or a social worker, to locate your spouse.

You can file a court case under Section 9 of Hindu Marriage Act of 1955, which stipulates restitution of conjugal right. Restitution of conjugal right is the Court intervening in a case and directing the party to rejoin the spouse because they may have abandoned the other.

According to Section 19 of the Hindu Marriage Act, 1955, a petition for restitution of conjugal rights shall be presented to the District Court within the local limits of whose jurisdiction one of the following conditions is met:
- The marriage was solemnized in that jurisdiction.
- The respondent (the party against whom the petition is filed, in this case, your wife) resides in that jurisdiction at the time of presenting the petition.
- The parties to the marriage last resided together in that jurisdiction.
So, you have the option to file the petition in any of the above courts.
