What is the procedure to change the lawyer

Sir/Madam my name is Deepa i live in bangalore my husband has sent me divorce notice 4 months back n case is going on in the family court my lawyer is very careless i have a 3.8 year old son m seeking for the maintenance but the lawyer is not coming on time to the court n he is not at all supporting me... so i want to change the lawyer so please sir/madam please let me know the procedures to change the lawyer

Hi, since you have a minor kid to take care of it is very much important that you are supported financially. Good that you have filed for maintanance.
To change the present lawyer you need to take NOC from them or if your lawyer does not want give you NOC or otherwise you still can change lawyer by filling an affidavit of you with the vakalath of new lawyer before the court thereby making your intention of engaging the service of new lawyer at the place of old lawyer very clear to court.

Deepa no worry it’s very easy. Take the NOC from the current lawyer give it to new lawyer so that he can present your cas in the family court.

What ever may be the case stage take NOC from your advocate and give it to new advocate who can take up the case madam..kindly explain him that your not satisfied with the work and later you can file NOC vakalath in the same court but with change of advocate..

Dear madam,
If you want to change your Advocate, you have to get No Objection from present Advocate to engage any other Advocate or if he denies to give No objection you can request to court permit you to change Advocate by filoing an affidavit before Court.

You can simply get a NOC (No-Objection Certificate) and hire another lawyer. If he does not agree, then issue him a notice terminating his Vakalat/Power immediately and hire another lawyer.
