What is the maximum duration for mediation in case of divorce

18-May-2023 (In Divorce Law)
My husband has filed for divorce in sessions court and I don't want to divorce him. My lawyer is planning to recommend the case into mediation. What is the maximum duration period of mediation (How long can it last)? What if mediation fails.Would divorce be granted automatically after the mediation period is over in case of the failure of mediation? My understanding is since I do not want to divorce him, divorce should not be automatically granted even after mediation fails and even after the failure of mediation we should still be able to go to court for legal resolution of the matter.

The maximum duration of mediation can vary depending on the state or jurisdiction where the case is being heard. However, typically, mediation proceedings can last up to six months. If mediation fails, then the court will proceed with the divorce case and make a decision based on the evidence presented.

It is important to note that even if mediation fails, it does not mean that the divorce will be automatically granted. The court will still consider the evidence presented by both parties and make a decision based on the merits of the case. If you do not want to divorce your husband, you can inform your lawyer and work towards a resolution that is mutually acceptable to both parties. In case the matter is not resolved through mediation, and the grounds of divorce that your husband is pressing against you stand proved in court, the divorce will become final.

In 2-4 meetings, a mediator can resolve the case. Divorce mediation can take longer than other cases because divorce is such a sensitive issue. It is also necessary to resolve different issues relating to children and property.
