Want to withdraw my Domestic violence case what to do

I have filled a dv case against my husband 7 months a ago and now just want to withdraw my case. but my advocate are saying its a big risk, opposite party can also do case against me, but my husband stays in Dubai, he attended 3 herring and then went back but advocate are doing nothing, so I just want a divorce and don't want to continue this case. I'm Muslim, so my advocates are saying i can't go to family court I have to go to some masjid where they do divorce. please advise thanks and regards,

U can file a separate divorce petition in family court and let this continues. This is diff than ur dv petition.do not withdraw it. Let the court dismissed it by passing a order. Please consult for further needs

It is always better to keep the DV case pending till you get everything settled. You can file for divorce and only a court of competent jurisdiction can grant divorce to you two. If your husband is willing to part ways without any fight, you can always get it amicably.

If you wants to withdraw your DV case then it can not be withdrawn because may be FIR is registered then you apply for quashing of proceeding and then apply divorce as per your Muslim custom.

As per muslim law U canttake Divorced Family court. YOU HAVE TO take khulanama from quazi . As per muslim law if you are leave seperate more than 3 yrs your husband have right to get marry .
As regarding Domestic Voilence case if you willing to widraw Domestic voilence case the you have to move simple pusis to widraw case from court. There was no harm to widraw case. If you want to widraw by own wish.
