06-Jul-2023 (In Divorce Law)
Hello i am a Buddhist and my husband is a hindu. Its been 11months to our marriage and iv been staying with my parents after 3 months of our marriage. I wanted to divorce him because after marriage i get to know the real colour of him.when i left him after 3 months he hacked my fb account and chatted with people to defame my character. He is mentally harassing my parents by messaging and threatening.. we have written an undertaking of divorce under mutual understanding before i left him. He even turn out to be a fraud as he took 130000 from me in the name of a admission in college and when i ask about the admission he refuses to answer. So please advice me as to what divorce should i opt for.thanks
A marriage between a Buddhist and a Hindu is governed by the provisions of Hindu Marriage Act. So you can apply for divorce under section 13 (1)(ia) of Hindu Marriage Act on the ground of cruelty against your husband wherein you can mention all the cruelty committed upon you indetail. Apart from that you can also file cases for invasion of privacy and a recovery suit for return the borrowed sum of Rs. 130000.
