Section 9 RCR, DV act and divorce petition under 13 A

I filed for section 9 RCR on date 24/7/17. Section 9 case is pending in court. Interim maintenance under section 24 is ordered to her on dt 14/3/18.I have not paid single rupee to her till date. Can I withdraw section 9 without paying arrears ? On date 15/6/18 she filed DV act under sections 3,15,17,18,19,20,22,23 & on same date 15/6/18 she filed code of criminal procedure 125. On date 21/2/2020 I filed for divorce under section 13 A cruetly & desseration. Can I get divorce ? Am I going right ? I m withdrawing my section 9 RCR case on next coming date of section 9.
yes it's been more then 2 yrs of separation. cruelty will need to be proved by evidence. but desertion is also one form of cruelty. so there is not much to worry about if u have a good lawyer. if u have any further queries call me.
