I have filed maintenance;DV case against my husband..I have also reported matter to police station and authority have asked manila cell to submit the report..I have reported my grievances to Army head quarter as my husband is in Army..He has received summons and yet couldn't file his reply due to lockdown and as such there is no representation from his side in the court.. My Question is why my husband has not FILED RCR Or Divorce Petition till date..My husband lives I westbengal and all these petitions have been initiated in Maharashtra where I am living with my parents..I am still a student of medical backgrounds and might not earn even in coming 4 years..I want to know the probabilities/Reasons of not initiating the available remedies with him.

No issue. He has to attend court once the court will resume. As he is serving in Arm Forces but for family disputes he has to deal in Civil court only. In Domestic Violence Act you might be have pressed on application for interim relief. If after receiving summons he will not b in court you can move for exparte order.

Dear queriest, as per your query you have mentioned about the fact that why your husband has not initiated any RCR or Divorce petition, since you have already filed for maintenance and DV, the reason may be due to lockdown firstly, secondly he must be trying to defend Now from DV and may prove you wrong if be must be having any proof against you, it is not at all compulsory that if you have filed DV so he is going to file RCR, may be he must be thinking some other ways, for more information in detail kindly call me.
