Hi, sir/madam. I am looking for the legal advice on divorce case, I have been married past 3 yrs.it was an arrange marriage,.due to my wife's unwanted behaviour and immature mind our relationship was not a good track from the first day of marriage. And their families are giving threat to my parents and sister that they will do something wrong to them. Since I am staying apart from them,I am working in hospitality sector in Bangalore. I visit my hometown once or twice in a year. Now I strongly took my decision to take divorce, they have been keep on arranging social meetings in my hometown and insulting my parents in front of the public,which is unbearable for me. my wife is complaining about my parents and sister that they torture her,which is a total lie,since my mother is a patient of high and low pressure she is sick most of the time and my father stays busy in his duty, about my sister she have been married and staying with her husband. Please advice me what should I do.thanks
Sir, I am advising you to take first step to lodge the complaint against your wife through your mother or sister to the women commission. thereafter take second steps to file a case against your wife along with her parents and her brother's before the magistrate. After this if she continues with the same manner with you and your parents, then you have option to lodge the complaint against your wife and her parents for the threat and harassment. Finally issue legal notice to HER for divorce. After knowing of her reply, then go and file divorce petition for the relief of divorce.

You can apply for divorce on the ground of cruelty under section 13(1)(ia) of Hindu Marriage Act. Better file it in Bengaluru and try to get ex parte divorce easily without alimony. If you could come to my office then I am in a position to give more legal advise on need basis.

You can go for divorce on the ground of desertion and mental harrasement. Everything you need to prove the mental harrasement only from day one to till date of divorce
Apart from this you can also take ground that she is not ready to live with your parents and harrasing them.

As family intervention failed, please take professional legal hep. You can mediate through Advocate and settle the matter amicably or else proceed with divorce petition so as to exit from the relationship. Mutual Consent Divorce is best option if reconciliation is not an conisderation.
