How much time i will get imprisonment for not paying permanent aliomany in execution case under section 25 of hma case for 1 year aliomany
Court is empowered to send the husband to civil prison if he doesn't pay the maintenance to his wife and children. Court may give orders to attach the property of husband to recover the arrears of maintenance but if wife is unable to present the list of property of husband and court is convinced that arrears could not be recovered by attaching property then court shall send a show cause notice to husband.
If court thinks that husband is deliberately avoiding to comply with orders of court and have given sufficient opportunity to clear the arrears, then court may put the husband in civil prison. Practically, it happens rarely and will be in days like 15 days to 30 days.
