My husband as filed a divorce case. He has taken 7years back adultery of me now and filed for divorce under cruelty. He has got the sms record but till now he didn't file that sms data in court. Can he submit that in court at the time of cross examination. As the case now came to the stage of his cross examination. In the middle of case can he submit them. Are they valid data because how can he get my number details. Please advice me. At any stage they can produce new evidence or not
Yes parties to the proceedings can file appropriate application for taking on record additional evidence available with them and it is the discretion of the court to accept our reject the said application. Ultimately the relevancy of such additional evidence is the prime factor while deciding the application by the court.
