Need help regarding divorce case after complaint at CAW CELL KAMLA MAR
10-Aug-2023 (In Divorce Law)
I am living separately from my husband since 6 months now.... i hv registered a complaint against him & my in laws at CAW CELL delhi.... we hv been given 6 dates since then but my husband has missed 4 dates out of it. They aren’t even admitting any streedhan item & are not ready to give anything... the officials there are quite lenient with my husband & in laws.... i need to know will i get back my jewellery & other belongings & how??? I want to register FIR against him but everyone at CAW wants us to get mediation.... my in laws don’t attend meetings & my case is being prolonged....how should I proceed...
I have perused your query and would advise you to file a complaint under section 12 of the Domestic Violence Act and seek maintenance, compensation, separate residence order and return of streedhan. CAW cell is a platform to get the matter settled through mediation, once failed, it will be transferred to mediation centre of the concerned court, thereafter only FIR will be recommended. claim heavy alimony and maintenance. Simultaneously you should file a maintenance petition under 125 CrPc. Further you may contact us.

they cant force you for mediation if you dont want to go ahead with it. if they refuse to file your FIR, you can approach the Court directly and get it registered. you can get back your jewellery and other streedhan items through court, once the FIR is registered

CAW cell serves as a platform for settling the dispute through mediation. If mediation fails, the case will be transferred to the mediation centre of concerned court. Only then will a FIR be recommended. Claim heavy maintenance and alimony. You should also file a maintenance request under the 125 CrPc.
