Need details about Ex parte divorce
03-Jan-2023 (In Divorce Law)
What is the rough cost estimate to proceed with the ex parte dicvorce & what is the procedure. Need someone to help me.
hi
1) if your opposite party has obtained, ex parte divorce against you, you should first get the ex parte decree set aside in the same court.
2) other side should be served notice of application to set aside ex parte.
3) Once ex parte order is set aside, then the standard procedure to dismiss/ Grant divorce will continue.
costs depend on various factors including why it was declared ex parte in first place and what are the relief (alimony, maintenance, property share, child custody etc) are claimed.
